These Terms & Conditions ("Terms") form a binding agreement between you and Mane Focus ("Mane Focus", "we", "us"), trading as Mane Focus, in relation to the Mane Focus web application and any related services (the "Service").
1. Acceptance
By creating an account or continuing to use the Service you agree to these Terms. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age to enter a contract in your country.
2. The Service
Mane Focus is a season-planning tool for competitive equestrians. It helps you manage horses, riders, shows, entries, results, training and related records. We may add, change or remove features from time to time.
3. Your account
You must provide accurate information and keep your login credentials confidential. You are responsible for activity carried out under your account. Notify us promptly if you believe your account has been compromised.
4. Acceptable use
You must not:
- use the Service for unlawful purposes, fraud or spam;
- infringe the intellectual property or privacy rights of others;
- upload malware, probe, scan or otherwise interfere with the security of the Service;
- scrape, mass-download or reverse engineer the Service, except as permitted by law;
- resell, sublicense or redistribute the Service without our written permission.
5. Intellectual property
Mane Focus and all associated software, documentation, branding and content (other than content you upload) are owned by Mane Focus and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan. You retain ownership of the content you upload; you grant us a limited licence to host and process that content solely to provide the Service to you.
6. Service availability
We work hard to keep the Service reliable, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Payments, subscriptions, taxes and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax collection, invoicing, renewals, cancellations and refund mechanics for paid subscriptions are governed by Paddle's Buyer Terms in addition to these Terms. Subscriptions renew automatically at the interval shown at checkout until you cancel. You can cancel at any time from your account or via the Paddle-hosted customer portal; access continues until the end of the paid period. Fees are stated exclusive of taxes unless otherwise noted.
8. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly violate our acceptable use rules. You may stop using the Service at any time. On termination, your right to use the Service ends; we will keep your data available for a reasonable export window before deletion in accordance with our Privacy Notice.
9. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid us (via Paddle) in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data, goodwill or opportunity. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.
10. Your indemnity
You will indemnify us against third-party claims arising from content you upload, your unlawful use of the Service, or your breach of these Terms.
11. Changes
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of New Zealand and the courts of New Zealand have exclusive jurisdiction over any dispute, without prejudice to mandatory consumer rights in your country of residence.
